Public Disclosure Documents - Town of Orrington and Eagle Point Energy Center (EPEC)

 

We offer the following documents pursuant to a FOAA request and eventual lawsuit filed by and on behalf of the Bangor Daily News (BDN).  We have never denied disclosure of these, but deferred their release for several reasons including pending litigation against Eagle Point Energy Center (EPEC) and the prior owners of the plant. 

The Select Board wanted to allow residents to view and examine these documents in conjunction with disclosure to the BDN.  The residents of Orrington have supported the Town’s efforts as we navigated through an auction, clean-up efforts, the fire event, and still maintain a commitment for the EPEC plant to return to full operation. 

The vested interest in the EPEC facility is the economic advantage the Town of Orrington will have in developing the Eagle Point Business Park.  The power and excess heat generated by EPEC will flow “behind the meter” to the business park and be offered to the business at a 60-70% discounted rate over Versant pricing. 

After years of not communicating updates or status of conditions, the foreclosure and auction of PERC was publicly announced in mid-2023 which was a shock to the entire community and industry.  The Town had to endure the entire fall season of 2023 of scheduled auctions, non-auctions, failed bids, and finally a successful auction. 

The Town was also forced to hold a Special Town Meeting to forego the automatic tax foreclosure on the PERC property.  The Maine DEP was very supportive of the Town facilitating who ever would be a potential new owner, and the permitting process was supposed to be “expedited” in just a couple of months. 

However, the October 2024 fire made our little Town the top news story for weeks on end.   Reminiscing on the excitement and enthusiasm we all held back then. We know many of you still maintain that excitement and enthusiasm to this day, as does the Town. 

At no point in this entire undertaking did the Select Board lose sight of Town residents and have always protected the citizens of Orrington.  We will continue working towards a successful relaunch of the EPEC facility.
